A DISPUTE between two Derby businesses ended in a man having his face slashed with a knife.

Fesal Akbar lashed out at his 32-year-old victim after a group of men came into Cafe Bake, in Normanton Road, armed with broom handles and mops.

The victim, who was not named in court, suffered a wound that required 18 stitches.

Derby Crown Court heard that the dispute began after telephone cards for a shoe shop in Normanton Road were delivered to Cafe Bake.

Tim Palmer, prosecuting, said: "Rather than return them, those responsible in the defendant's business sold them and kept the proceeds, causing ill-feeling with the intended recipients."

Mr Palmer said that when the group arrived at Cafe Bake, Akbar had been in a position of having to defend himself "but the victim was there also, apparently as a peacemaker". "He was not offering any threat to this defendant or anyone - he wasn't one of the armed men," said Mr Palmer, speaking about the victim.

He said that Akbar had struck out once with the knife, causing the wound on the man's face.

Akbar, of Village Street, Normanton, admitted a charge of wounding.

Clive Stockwell, for Akbar, said the 21-year-old was very well- regarded in his community and put in a lot of effort and work for his family, his extended family and the community.

"I acknowledge on Mr Akbar's behalf, the complainant, although party to the group that came in, was physically not playing an aggressive part," he said.

Mr Stockwell said that since the incident the cafe venture had come to an end and Akbar was now working as a tyre fitter.

Judge John Wait sentenced Akbar to 12 months in jail, suspended for 18 months.

Judge Wait said: "I accept that when men, angry and armed, came into the shop then there was potentially a need to defend yourself, but not with a knife and not towards a man who was not an attacker."

Akbar must abide by a fourmonth curfew, between 7.30pm and 5.30am and carry out 120 hours of unpaid work.

He was also ordered to pay Pounds 500 towards court costs.
